Purchase and return terms

1. Seller and scope
These terms govern consumer purchases from the Ground Tactical shop. The seller is Eloy Pastor Tomás, tax identification number 44636737Q with a business address at Calle Holanda 2, oficina 4, 28971 Griñón (Madrid), España.

- Delivery area: mainland Spain and the Balearic Islands, metropolitan France, mainland Portugal, Germany and Italy. Selected equipment is available internationally. We exclude the Canary Islands, Ceuta, Melilla, French overseas territories, Madeira, the Azores, Heligoland, Büsingen, Livigno and Campione d’Italia. Availability and shipping costs depend on carrier coverage and are confirmed before payment.
The identification in the Legal notice and the product, price, delivery and payment information displayed before payment form part of the contract.
2. Products and shop scope
Ground Tactical sells airsoft equipment, accessories and consumables online.
Before buying, check the features, sizes, dimensions and compatibility listed on the product page.
3. Orders and contract formation
Adding products to the basket does not constitute order acceptance. Before payment, the shop displays products, quantities, taxes, shipping costs and the total price. Prices and amounts are recalculated securely before payment.
The purchase is confirmed when payment is accepted and Ground Tactical sends confirmation. Ground Tactical may cancel the affected order and refund all amounts paid in the event of a genuine stock error, an obvious pricing error, reasonable indications of fraud or an inability to complete a necessary order-processing check.
4. Prices and payment
Prices are in euros and include applicable VAT. Shipping and any other mandatory costs are shown before placing the order. Payment is processed through the secure checkout gateway; Ground Tactical does not receive full card details.
5. Delivery
For mainland Spain and the Balearic Islands, standard shipping starts at 5,90 € on orders below 150,00 €; shipping is free above this threshold within Spain. International shipping is calculated for the address and carrier selected and is not covered by this offer. The final cost is always shown before payment.
Estimated delivery within Spain is 2–3 working days. This includes transport to the customer's address. International delivery times depend on the destination and carrier. Where a product lists a different timeframe due to availability or its characteristics, the timeframe communicated before order confirmation applies. Unless another period is agreed, delivery will take place without undue delay and within 30 calendar days of the contract. Risk passes when the customer or a nominated third party other than the carrier physically receives the goods.
Please check the parcel on arrival. Report visible damage as soon as reasonably possible so it can be documented with the carrier; a later report does not remove mandatory consumer rights.
We ship from Spain to France, Portugal, Germany and Italy, only to areas and addresses accepted at checkout. Delivery charges and estimated delivery times are shown before payment. Domestic free delivery does not apply to these destinations.
6. Right of withdrawal
Consumers may withdraw from an online purchase without giving a reason within 14 calendar days after they or a nominated third party receive the products. For products delivered separately, this period starts on receipt of the last item.
To exercise this right online, use Manage return, permanently available in My orders. This records the selected products, declaration, date and time and promptly emails an acknowledgement. You may also send an unequivocal withdrawal statement before the deadline to info@groundtactical.com. You may use the form in section 13, but this is not compulsory.
After notifying withdrawal, you have a further 14 calendar days to send the goods back. For domestic withdrawal returns, our optional label costs 6,00 € and is deducted from the refund if you agree to use it and accept the deduction. You may also arrange a suitable carrier yourself. International returns follow the section below. No restocking fees apply. Do not send cash on delivery.
International delivery and returns
For withdrawal due to a change of mind, preferences, an incorrectly chosen size or incompatibility accurately described on the product page, the buyer pays the direct costs of packaging and return transport to Spain. You have 14 calendar days from receipt to notify us of withdrawal and a further 14 calendar days from that notification to send the goods back. You do not need to give a reason.
You may arrange a suitable carrier yourself or request a label from Ground Tactical. Our international label is optional: its direct cost depends on the country, weight and dimensions and is quoted for your acceptance before booking. There is no fixed €6 international rate. If you accept the label and its deduction, only that amount will be deducted from the refund. We do not add handling, restocking or supplier penalties.
If the product has a lack of conformity covered by the legal guarantee, a manufacturing defect, damage during transport arranged by Ground Tactical or we sent the wrong item, Ground Tactical pays the necessary collection or return costs and the costs of the applicable legal remedy. Buyers are not charged for exercising these rights. Sending a size different from the one ordered or providing an inaccurate description is not treated as a change of mind.
Notify us through your account or by emailing customer support, identifying the order and items. For a problem, describe it and include photographs if possible. We will provide the return address in Spain and transport instructions. You may also use the seller’s address stated in these terms; prior authorisation is not required to exercise withdrawal. Do not send goods directly to the manufacturer or supplier. Pack them safely and keep proof of dispatch; we recommend a tracked service.
Voluntary size or model exchanges are handled as a return and a new order. The buyer pays return transport and the new order’s delivery charges shown before payment. This does not apply to replacements required for lack of conformity.
These cost terms apply to purchases made after publication. More favourable terms communicated at purchase will be honoured, including a €6 label if offered for that order. This policy does not limit legal guarantees or mandatory rights applicable in the consumer’s country of residence.
7. Condition of goods and return transport
Opening packaging or a seal does not in itself exclude withdrawal rights, including for BBs and gas. You may inspect goods as needed to establish their nature, characteristics and functioning. Consumption, mixing, damage or handling beyond that inspection may result in a deduction for actual, documented diminished value, without automatic penalties.
For gas, aerosols, batteries or other restricted goods, contact us before arranging transport: use a service and packaging authorised for the contents. If goods cannot normally be returned by post, we will state the return cost or a reasonable estimate before purchase. These instructions do not restrict notification of withdrawal.
8. Refunds
For full withdrawal, Ground Tactical refunds the amount paid for the goods and the cost of the least expensive standard delivery offered within 14 calendar days of notification. The surcharge for a more expensive delivery selected by the customer is not refunded. For partial returns, we refund the amount paid for returned goods and any delivery charges legally due.
Refunds use the original payment method and may be withheld until the goods or evidence of their return are received, whichever occurs first. Any reduction for loss of value will be explained and documented.
9. Defects and statutory warranty
New goods have a three-year statutory conformity warranty from delivery. For a lack of conformity, consumers may request free repair or replacement unless the chosen remedy is impossible or disproportionate, and may request a price reduction or termination where legally applicable.
Withdrawal and warranty are separate rights. Depreciation rules for returns do not limit claims for products arriving faulty, leaking, damaged or different from those ordered. Damage directly caused by misuse, unauthorised modification, disassembly or failure to follow the manufacturer's instructions is not an original defect.
10. Cancellation before dispatch
Request cancellation as soon as possible. If the order has not entered dispatch, Ground Tactical will cancel it and refund payment. If it has already been handed to the carrier, the statutory withdrawal and return procedure applies.
11. Complaints
Send enquiries and complaints to info@groundtactical.com. Include the order number, a clear explanation and photographs where appropriate. Ground Tactical will respond within the applicable statutory period.
Ground Tactical is not currently affiliated with a specific consumer arbitration body unless expressly stated for a dispute. This does not prevent access to competent public consumer information or alternative dispute resolution services.
12. Applicable law
These terms are governed by Spanish law, in particular the consolidated consumer protection legislation. Disputes will be heard by the courts determined by mandatory consumer rules, without imposing a jurisdiction that deprives consumers of the one legally available to them.
The binding version of these terms is Spanish. Translations are provided for information. Mandatory consumer rights, including those applicable in the consumer's country of residence, always apply regardless of any wording in these terms.
